General Terms and Conditions (GTC) for participation in the betting syndicates via the online portal www.dein-lottoclub.com.

1.    Participation / Contractual partner / Participation account
1.1    Before participating in a lottery syndicate, please read these terms and conditions carefully. By registering and participating in a betting community, you as a participant in a betting community accept these GTC and agree to the privacy policy. The GTC can be amended at any time. Changes to the GTC will be announced on our website before they come into force. Any material changes will be notified to participants in advance and participants must confirm acceptance before the changes come into effect. In such cases, any terms which are added, removed or changes shall be highlighted and participants who fail to accept the updated GTC shall be prohibited from playing but shall be able to withdraw their balance. By continuing to participate, the participant agrees to the amended GTC.

European Lotto and Betting Limited (“ELBL”), a company registered and licensed in Malta and regulated by the Malta Gaming Authority on 25/02/2019 (licence number MGA/B2C/609/2018), authorised to offer casino, secondary lotteries and fixed odd betting, including live betting services. ELBL’s commercial register number is C84690 and its registered office is Level 5, St. Julian's Business Centre, Elia Zammit Street, St. Julian's, STJ3153, Malta (EU). 

1.2    The systems offered on the www.dein-lottoclub.com website (‘Website’) also refer to the name of the respective betting community. Several syndicates with the same system name are distinguished by the corresponding system number. Each syndicate bets on different numbers, which are communicated to the participant via their personal participation account after payment of their stake.

1.3    By participating in a betting pool, the participant takes part in the bets placed on the results of state lotteries such as the German Lotto 6 out of 49, Spiel 77, EuroJackpot or EuroMillions via ELBL.

1.4    A participant must register personally and is only authorised to register and maintain a single participation account on dein-lottoclub.com at any one time. If ELBL detects multiple registrations, ELBL may delete them.

1.5    ELBL has undertaken not to accept any persons under the age of 18. The name, address and date of birth may be verified by ELBL directly or through specialised service providers for verification of age and compared with the data available there by means of an identity check. If the applicant’s data cannot be determined via a service provider, the Postident procedure can be used and a credit check is carried out.

1.6    The following persons will be prohibited from registering with dein-lottoclub.com: 
•    any person citizen of or resident in a country listed by the Financial Action Task Force as posing a risk to the international financial system as set out in the “Countries” section of http://www.fatf-gafi.org under “High-Risk Jurisdictions subject to a Call for Action” and “Jurisdictions under Increased Monitoring” as varies from time to time by FATF;
•    any person listed on the financial sanctions list of HMRC, as varied from time to time; and
•    any person citizen of or resident in the United States of America.

1.7    The participant is obliged to update their account details. For example, if they move house, get married or change their name.

1.8    Participants are prohibited from selling or transferring their participation account to other participants and/or acquiring it from other participants.

1.9    It is the participant’s responsibility to keep the registration data safe and ELBL cannot be held responsible for unauthorised use of the participation account if ELBL is not at fault.

1.10    The following methods are available to the participant for deposits and withdrawals:

1.11    Deposits by the participant are limited to EUR 1,000.00 per month. ELBL may limit payments by direct debit to between EUR 30.00 and EUR 200.00 per week, depending on the Participant’s creditworthiness.

1.12    Participation in the game requires that new participants verify their identity within 30 days of registration. If verification is not completed within this period, ELBL reserves the right to refuse participation to the person concerned. Credits can only be paid out after successful verification.

1.13    ELBL are not banking institutions. Participants’ credit balances in the participant account do not earn interest.

2.    Types of participation
2.1    ELBL offers participation in lottery syndicates with the lotteries described in section 1.3. The types of participation are drawing game and monthly game. For this purpose, the participant can select the lottery and system type as well as the number of participants.

2.2    Drawing game
Participation in the drawing game can only be made online via the website www.dein-lottoclub.com. The participant selects the desired system for the respective lotteries, as well as the number of participants, the quantity of systems and the number of draws of 1 to 8 draws. The participation fee must be paid immediately using the payment method specified on the website. The participant will then immediately receive the system number combinations and, at the latest shortly before the start of the draw, a confirmation of participation in accordance with point 4 of these GTC, which documents their pro rata claim to the prize. The lottery winnings are settled and credited to the personal participation account on the first working day after each draw.

2.3    Monthly game 
Participation in the monthly game can be made online via the website www.dein-lottoclub.com, by eMail or postal mail. The participant selects the desired system for the respective lotteries, as well as the number of participants and the number of systems. A monthly game takes part in all draws of the respective lottery in the monthly participation period. The participation period usually corresponds to one calendar month and will be communicated to the players via the Website, by eMail or postal mail. Only one monthly game is possible at a time. Systems for all lotteries can be combined for one monthly game. The participation fee must be paid before the start of the participation period using the payment method specified on the website. The participant will receive, at the latest shortly before the start of the first draw, a confirmation of participation in accordance with point 4 of these GTC, which documents their pro rata claim to the prize. The winnings are settled after each draw and announcement of the respective odds and credited to the personal participation account at the end of the monthly participation period. Participation in the monthly game can be cancelled or changed by the participant at any time to the end of the selected participation period. If there is no change or cancellation requested by the participant, the same monthly game combination automatically goes into play for the following monthly participation period and has to be paid before the start of each monthly participation period.

3.    Participation fees
The participation fee in a syndicate is made up of the number of picks, the number of participants and the quantity of systems. On average, it consists of 2/3 stake and 1/3 organisation and administration fees and taxes. There are no other fees or similar.

4.    Confirmation of participation
4.1    The participant receives that part of the total prize per system/tip pool that corresponds to the number of participation and system ordered, provided that the participation fee has been paid on time. The confirmation of participation that the participant receives before the start of the game is decisive. The confirmation of participation includes the data listed under point 4.3.

4.2    If payment is made by direct debit, confirmation of participation can also be issued without a bank booking. As a rule, the fee will be debited from the participant's current account within three working days of registration. The participant undertakes to ensure that there are sufficient funds in the account. Confirmed entries or draws are excluded from the right of cancellation. Any costs incurred in the event of returned direct debits will be charged to the participant.

4.3    ELBL will confirm this to the participant before the start of the respective draw or play period:
a)    all lines and numbers of the systems that relate to game participation,
b)    the draw(s) or game period and lottery being played,
c)    the ticket numbers for the purpose of checking the Super Number and extra games like Super6 and Spiel 77,
d)    the number of participants per system. 
At the end of the draw or playing period, the total winnings of the respective syndicate will be divided by the confirmed number of participants.

5.    Order
5.1    Once an order to participate in a lottery pool has been submitted, it can no longer be changed or cancelled by the participant.

5.2    The participant agrees not to make any chargebacks, reversals, or other cancellations of payments to the participant's account and to compensate ELBL appropriately in the event that these nevertheless occur, including all costs incurred by ELBL in the process of collecting outstanding payments. In addition, ELBL may refuse to accept further payments from such a participant in the event of a returned direct debit. ELBL is authorised to refer all such claims against a participant, including any additional and reasonable charges, to a debt collection agency.

5.3    Money transactions are monitored on the basis of the provisions of the Money Laundering Act to be complied with by ELBL. Suspicious transactions are reported to the relevant supervisory authorities. We expressly point out at this point that it is illegal to deposit money into the participation account that originates from the proceeds of criminal activities.
ELBL may cancel an order in the following and similar cases:

5.3.1    If the acceptance deadline for an order is exceeded, ELBL reserves the right to reject or postpone the order. If the order is rejected by ELBL, all payments included in the order will be cancelled and the participation fee will not be charged or will be refunded.

5.3.2    If the proper processing of an order cannot be guaranteed due to a software error, ELBL has the right to cancel the order. ELBL will inform the participant immediately.

5.3.3    In the event of a software failure, it is at the discretion of ELBL to cancel the order or to wait for an alternative solution. ELBL will endeavour to rectify the software failure as quickly as possible, but cannot accept any liability for delays or damages incurred.

5.3.4    In the event of internet disruptions that prevent the order from being processed properly, ELBL may cancel the order.

5.3.5    The participant will be informed of the suspension of the acceptance of Betslips.

5.3.6    In the event of force majeure such as natural disasters, war, terrorism, political unrest, or other unforeseeable circumstances that make it impossible to process the order properly, ELBL may cancel the order free of charge. ELBL accepts no liability for damage or delays caused by force majeure.

5.4    At any time and at its own discretion, ELBL may limit or refuse bets in the case that they are considered to be too large or if a betting pattern is detected which gives rise to suspicion of system abuse

6.    Claim of Winnings
6.1 The entitlement to prize distribution is based exclusively on the data that ELBL has confirmed to participants in the entry confirmation.

6.2 The lottery winnings achieved by the betting syndicates/systems will be distributed 100 per cent to the participants after the respective draw.

7.    Accounting of Winnings
7.1  After each completed draw or playing period, a detailed statement of winnings is issued for each participant, broken down by system and game type.

7.2 The total winnings of each syndicate/system will be distributed according to the data confirmed by ELBL. The winnings of the betting syndicates will be credited by ELBL for all drawing and continuous games to the participants’ accounts without delay. Distributed winnings of the monthly games with be accrued over the course of the participation period and credited to the participation account at the end of the participation period. 

7.3  Objections to the profit statement must be notified to ELBL in writing. The prize statement is deemed to be recognised unless written objections are raised within two weeks of receipt of the statement of winnings.

8.    Payout of winnings
8.1  ELBL maintains a participation account for each participant, to which the participation fee is debited and the prize payout is credited.

8.2  A credit balance remains in the participation account until the participant arranges the payout themselves.

8.3  The payout of a credit balance can be initiated directly via the corresponding website. Payouts of more than €1,000.00 will only be made after ELBL has received the winnings from the lottery company.

8.4  Payments can only be made to the account from which the deposits were made to the participation account. Where this is not possible, ELBL reserves the right to remit such funds in accordance with any applicable anti-money laundering legislation.

8.5  ELBL will carry out additional verification procedures for any cumulative deposits of €2,000.00, on the basis of a rolling period of 180 days.

9.     Exceptional Circumstances
9.1  Unexpected technical problems or circumstances outside ELBL‘s control, such as technical problems at third party providers, allows ELBL to cancel bets and give refunds to participants.

9.2    Events not started on time for any reason or even postponed may be kept open and all bets remain valid if they kick off (start) within the next 48 hours from the official start time. In any other case, ELBL reserves, at its own discretion, the right to void all bets of such postponed event and refund the stakes to the participant.

9.3    If events are abandoned after their official start time and are continued by the official organisers within 48 hours from the original start time, ELBL reserves the right to keep all bets valid and settle according to this result.

9.4    If events are abandoned after their official start time and confirmed not to continue by the official organiser within 48 hours from the original official start time, ELBL will settle all determined markets decided on the pitch at the time and void the rest by refunding stakes to the Players. However, in cases like this, ELBL reserves, at its own discretion, the right to void all bets of such abandoned events and refund the stakes to the participants.

9.5    When an event is cancelled, all bets related to that event will be void and participant accounts will be refunded.

9.6    In the case that a participant is refunded, for whatever reason, the amount refunded shall be returned to the participant’s account, the participant shall be informed, and the procedure finalised within 48 hours after the decision has been made.

10.    Inactive Accounts
10.1 An inactive participation account is an account which has not been accessed for 12 consecutive months and that has a real money balance.

10.2   ELBL will notify the participant via email once the participation account becomes inactive, allowing the participant 30 days within which to reactivate the account, following which an inactive fee will be charged.

10.3  When a participation account becomes inactive, ELBL may charge an inactive fee of €5.00 (or equivalent currency) per month administrative fee on the account, for as long as there are funds in the account.

10.4  The inactive fee will be deducted from the participant’s account balance until the earlier of: (a) the participation account balance being reduced to zero; or (b) the participation account being reactivated by the participant using the participation account to carry out betting activity. In each situation, the inactive fee will cease to be deducted.

10.5  An account which is inactive as a result of self-exclusion shall not be charged any inactive account fees until such period of self-exclusion lapses. 

10.6   If the participation account is still deemed as inactive 28 days after the notification, the participant’s claim to the account balance expires. ELBL is entitled to use the account balance at their discretion including, and not exclusive of, a donation to a charitable organisation.

11.     Lotteries and odds
11.1  Lotto 6aus49 is a Lotto game with reference to the German "Lotto 6aus49". "Lotto 6aus49" is organised by the German Lotto and Totoblock (hereinafter referred to as "DLTB"). In "Lotto 6aus49", six numbers ("winning numbers") from the numbers 1 to 49 and one
"Super Number" drawn from 10 numbers (0 to 9). Draws are held on Wednesdays and Saturdays. The super number is the last digit of the ticket number on the ticket. There are 9 prize categories.

11.2   The prize to be paid out with regard to an ELBL Lotto winning tip in prize categories 3 to 9 corresponds to the prize quota published by the DLTB in the respective prize category.

11.3   The winnings that can be paid out with regard to an ELBL Lotto winning pick in prize categories 1 and 2 depend on the number of ELBL Lotto winning picks in the respective prize category, the number of DLTB winners in the respective prize category and the winnings that can be paid out by DLTB in the respective prize category.
Example 1: If there is only one ELBL Lotto winning tip and no winner from the DLTB in Lotto 6aus49, the amount that can be paid out is 100% of the jackpot amount or the winning amount of prize category 2.
Example 2: If there is an ELBL Lotto winning tip and a winner from the DLTB, the amount that can be paid out is 50% of the jackpot amount or the winning amount of prize category two.
Example 3: If there are two ELBL Lotto winning picks and only one winner from the DLTB in Lotto 6aus49, the amount that can be paid out per winner is 33 1/3% of the jackpot amount, or the winning amount of prize category 2.

11.4    The prize payout in prize categories 1 and 2 is limited to €50 million in each case.

11.5    Spiel 77 is an ELBL Lotto game that can only be played in conjunction with the ELBL Lotto game Lotto 6aus49. Spiel 77 is based on the supplementary lottery "Spiel 77", which is organised by the DLTB. In "Spiel 77", the DLTB draws a seven-digit winning number between 0000000 and 9999999. Draws are held on Wednesdays and Saturdays.

11.6   The winnings payable in respect of an ELBL Lotto winning pick in prize category 1 depend on the number of ELBL Lotto winning picks and the number of DLTB winners and the winnings payable by DLTB in prize category 1. The prize to be paid out in prize categories 2 to 7 corresponds to the prize quota published by the DLTB for "Spiel 77" in the respective prize category.

11.7    EuroJackpot is an ELBL lotto game based on the European lottery "EuroJackpot", which is co-organised by the DLTB, among others. In "EuroJackpot", five numbers ("winning numbers") are drawn from the numbers 1 to 50 and two numbers ("Euro numbers") from the numbers 1 to 12. Draws are held on Tuesdays and Fridays. There are 12 prize categories.

11.8    The prize to be paid out with regard to an ELBL Lotto winning pick in prize categories 3 to 12 corresponds to the winning odds published by the DLTB or a co-organiser with regard to the number of EuroJackpot winners in the respective prize category.

11.9   The winnings that can be paid out with regard to an ELBL Lotto winning pick in prize categories 1 and 2 depend on the number of ELBL Lotto winning picks in the respective prize category, the number of EuroJackpot winners in the respective prize category, the winnings that can be paid out by DLTB or its co-organisers in the respective prize category:
Example 1: If there is only one ELBL Lotto winning tip and no winner from the DLTB or a co-organiser, the amount that can be paid out is 100% of the jackpot amount or the winning amount of prize category 2.
Example 2: If there is an ELBL Lotto winning tip and a winner from the DLTB or a co-organiser, the amount that can be paid out is 50% of the jackpot amount or the winning amount of prize category 2.
Example 3: If there are two ELBL Lotto winning picks and only one winner from the DLTB or a co-organiser, the amount that can be paid out per winner is 33 1/3 % of the jackpot amount or the winning amount of prize category 2.

11.10   EuroMillions is an ELBL lotto game based on the European lottery "EuroMillions", which is co-organised by Loterías y Apuestas del Estado, or LAE for short (draw in Paris), among others. In "EuroMillions", five numbers ("winning numbers") are drawn from the numbers 1 to 50 and two numbers ("star numbers") from the numbers 1 to 12. Draws are held on Tuesdays and Fridays. There are 13 prize categories.

11.11   The prize to be paid out with regard to an ELBL Lotto winning tip in prize categories 3 to 13 corresponds to the odds published by LAE or a co-organiser with regard to the number of EuroMillions winners in the respective prize category.

11.12   The winnings that can be paid out for an ELBL Lotto winning pick in prize categories 1 and 2 depend on the number of ELBL lottery picks in the respective prize category, the number of EuroMillions winners in the respective prize category, the prize payable by LAE or its co-organisers in the respective prize category:
Example 1: If there is only one ELBL Lotto winning tip and no winner from LAE or a co-organiser, the amount that can be paid out is 100% of the jackpot amount or the winning amount of prize category 2.
Example 2: If there is an ELBL Lotto winning tip and a winner from LAE or a co-organiser, the amount that can be paid out is 50% of the jackpot amount or the winning amount of prize category 2.
Example 3: If there are two ELBL Lotto winning picks and only one winner from LAE or a co-organiser, the amount payable per winner is 33 1/3 % of the jackpot amount or the prize amount of prize category 2.

11.13   If there has been no winner from LAE or a competitor in prize categories 1 and/or 2 in four consecutive EuroMillions draws with a jackpot amounting to the upper prize limit, LAE or a competitor is obliged to pay out the winnings from prize categories 1 and/or 2 to the lower prize categories. In this case, the payout rule set out in 11.12 shall be applied with the assumption that there would be no payout of prizes in prize categories 1 and/or 2.

12.    Responsible Gambling
12.1  A participant may, at any given time, choose to limit the deposit amounts at their own discretion. 

12.2   A participant may, at any given time, choose to limit the amount of money that can be lost or the amount of time spent on dein-lottoclub.com within a given timeframe.

12.3    A participant may, at any given time, choose to limit access to their account for a definite or indefinite period of time, during which the account will not be accessible to the self-excluded participant.

12.4   A self-exclusion request is only valid for the website and does not include other sites operated by ELBL.

12.5   Any limitation implemented by the participant will be removed upon expiry of the said duration or upon the participant’s request after submitting an explanation as to why self-exclusion was requested and providing evidence that they are now able to manage their gambling safely and sustainably. 

12.6   Upon receiving a request to remove a period of self-exclusion, the participant will be granted access after 24 hours from the request for a definite self-exclusion, and after 7 days for an indefinite self-exclusion. 

13.    Privacy Policy
13.1  The participant acknowledges and accepts that it is necessary for ELBL to collect and use personal data in order to allow the participant access to the use of dein-lottoclub.com. 

13.2   ELBL acknowledge that by collecting personal data, they are bound by the General Data Protection Regulation (EU) 2016/679, and the Data Protection Act, Chapter 586 of the laws of Malta. ELBL will protect participants’ personal information and respect their privacy in accordance with best business practices and applicable laws.

13.4  Participants’ personal data will be used by ELBL to allow them to participate in draws and to carry out relevant actions in relation to participation in the draws. 

13.5 When an account is opened, participants’ data may be processed for anti-money laundering purposes.

13.6   Participants’ personal data will not be disclosed to third parties, unless such disclosure is necessary for processing participants’ requests in relation to participation in the draws, is specifically allowed by participants or is required by law. Participants hereby consent to such disclosures.

13.7  ELBL may have to share participants’ personal data with the following recipients or categories of recipients:
•    Other companies in the Lottoland Group acting as joint controllers or processors and who provide customer services, IT, and system administration services.
•    Identification verification agencies and fraud prevention agencies used to provide customer due diligence including, money laundering, fraud, sanction checks in the context of our AML/CFT/CFP or responsible gambling obligations.
•    ELBL may share information with a third-party verification provider and/or credit reference agency and this will leave a “soft” footprint on the participant’s credit file.
•    External third parties to provide marketing and promotional services on ELBL’s behalf.
•    Third parties to whom ELBL may choose to sell, transfer, or merge parts of its business or their assets to. Alternatively, ELBL may seek to acquire other businesses or merge with them. If a change happens to ELBL’s business, then the new owners may use participants’ personal data in the same way as set out in these terms and conditions.
•    Service providers who provide IT and system administration services.
•    Professional advisers, including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services to ELBL.
•    Regulators and other authorities who require reporting of processing activities in certain circumstances. 

13.8  In order to provide participants with an efficient service, ELBL may require to transfer participants’ personal data to a country outside the EU. In this case, details of the transfer will be provided and reference will be made to the appropriate or suitable safeguards. Whenever personal data is transferred to a country outside the EU, ELBL will take measures to ensure that the participants’ personal data is protected to the same standards as it would be within the EU.

13.9   ELBL and DLC will retain personal data for as long as the participant remains a customer with us and for no longer than six years from the moment the participant closes their account.

13.10  Participants have the right to access personal data held by ELBL or DLC about them, as well as to rectify, erase and restrict it whilst having the right to data portability requests.

13.11  A participant may object to the processing of their data and may withdraw consent, if the processing is based on consent.

13.12   A participant has the right to lodge a complaint with the relevant supervisory authority. 

14.    Anti-Money Laundering
14.1   It is unlawful to deposit money obtained from criminal activities.

14.2   All transactions are monitored to prevent money laundering.

14.3   ELBL will report any suspicious transactions to the competent regulatory body.

15.     Legal basis
15.1  Participation in the betting syndicate is the responsibility of the participant. They must ensure that participation is legal in the area in which they are playing.

15.2  The basis is the applicable law and laws of Malta. If the participant has the GTC in several languages, the participant can choose the most favourable version in the event of a conflict.

16.    Complaints
16.1  The complaints procedure has three levels. Participants may contact customer service via email at dlc-service@dein-lottoclub.com. Each correspondence shall be marked as “Complaint” and shall receive a reference number, provided that a reference number has been allocated to the relevant complaint. 

16.2  At the first level, the complaint is processed by a customer service employee. At the second level, the complaint is processed by Head of Customer Service. At the third level, the complaint will be dealt with by the legal department of ELBL.

16.3   The complaints procedure, including internal escalation, will not take longer than ten days from receipt of the complaint. Under certain circumstances, this period may be extended by a further ten days if the participant does not cooperate in resolving the complaint in a timely manner.

16.4   A participant has the right to refer a dispute to eCOGRA, an Alternative Dispute Resolution (ADR) entity which considers cases regarding betting or gaming transactions, if they are not satisfied with the response given by ELBL. Current eCOGRA ADR rules will apply as set out on the eCOGRA website under the ADR Policies and Procedures for Assistance section athttps://ecogra.org/products-services/alternative-dispute-resolution. Participants can file a dispute with eCOGRA by completing the online adjudication form available here: https://ecogra.org/products-services/alternative-dispute-resolution. 

16.5    If a participant is not satisfied with the outcome of their complaint, they can contact the Malta Gaming Authority by email at support.mga@mga.org.mt or via the link http://www.mga.org.mt/support/online-gaming-support/.

16.6    If a participant feels that the service provided by ELBL is in breach of the applicable laws and regulations, they may contact the Malta Gaming Authority by email at support.mga@mga.org.mt or via the link http://www.mga.org.mt/support/online-gaming-support/.
